Please read these Terms of Service carefully before using Overcome. By creating an account or using the app, you confirm that you have read, understood, and agreed to be bound by these terms. If you do not agree, do not use the app.

1. Parties to This Agreement

This Terms of Service agreement is between:

By downloading, installing, or using Overcome, you enter into a legally binding agreement under the terms set out below.

Platform availability. Overcome is currently available on Android via Google Play only. Where these Terms refer to the Apple App Store or iOS, those references apply only if and when Overcome becomes available on that platform, and we will update these Terms before that happens.

You must be at least 18 years of age to use Overcome. By using the app, you confirm that you meet this requirement.

2. What Overcome Is — and What It Is Not

Nothing in the app constitutes medical advice, psychological treatment, or a clinical intervention of any kind. Overcome is not affiliated with any medical or clinical institution.

3.1 Age Requirement

You must be 18 years of age or older to create an account. By registering, you confirm this.

Where we find that an account belongs to a person under 18, we will terminate it and delete the associated data. We will also request a refund of the unused portion of any subscription period through Google Play. No Cashback Guarantee claim can be made on such an account, and any claim already submitted will be void.

3.2 Account Responsibility

You agree to:

Account authentication is managed by Descope, a third-party identity platform. Your credentials are processed and stored securely by Descope in accordance with their privacy policy at descope.com/privacy.

4. Subscriptions and Billing

4.1 Available Plans

Overcome offers two subscription plans. Both include the Cashback Guarantee described in Section 5, with different guarantee structures. Read Section 5 carefully before choosing.

Each plan renews on the same cycle as its duration: the 90-Day Reset renews every 90 days, and the 180-Day Full Reset renews every 180 days. Your access period and your billing period are always the same length.

All prices are in Indian Rupees (INR) inclusive of applicable taxes, displayed in the app at time of purchase. Prices may change but will not affect active periods already paid for. Where a price increase applies to your next renewal, Google Play will notify you in advance and you may cancel before it takes effect.

Promotional pricing means any introductory offer, discount, coupon, launch price, or reduced rate applied to your purchase. Where you buy at a promotional price, all references in these Terms to "the amount you paid" mean the discounted amount actually charged to you, not the standard price.

4.2 Billing and Auto-Renewal

Subscriptions are billed in advance. Unless cancelled before renewal, your subscription auto-renews at the then-current price for the same period length. All billing is managed by Google Play. Overcome does not hold your money, does not store payment card details or financial credentials, and cannot charge or refund you directly — every payment and every refund passes through Google Play.

4.3 Cancellation

Cancel anytime through your app store subscription settings:

Cancellation prevents future renewals but does not entitle you to a refund for the current period, except as provided in Section 5.

4.4 Failed Payments

If a payment fails, access may be suspended until payment is processed. We are not responsible for loss of streak data or programme continuity due to payment failure.

5. The Overcome Cashback Guarantee

The Cashback Guarantee is available on both plans. It is a performance-based cashback — not a no-questions-asked refund. The guarantee structure differs between plans. Read this section carefully before purchasing.

5.1 How the Guarantee Works

If you complete all required challenge weeks across your guarantee period and do not experience any meaningful improvement, you may claim 90% of the amount you paid back. The remaining 10% covers platform fees and programme infrastructure costs.

You decide whether you improved. Whether you experienced meaningful improvement is judged entirely by your own standards. We do not define improvement, do not measure it, and do not assess it. We will not ask you to justify your answer, will not request evidence, and will not reject a claim on the basis that we disagree with your view of your own progress. Your Clarity Score, streak length, and check-in ratings are not used to evaluate improvement and have no bearing on this part of the claim.

In practice this means there is exactly one objective test: did you complete every required week? If you did, and you tell us the programme did not meaningfully help you, the claim is approved.

5.2 What Counts as a Completed Week

A "completed week" is defined as a week in which every assigned challenge has met its individual completion threshold as recorded automatically by the app. Different challenges carry different thresholds — some require 3 out of 7 days, some 4 out of 7, and some 5 out of 7. These thresholds are displayed in the app for each challenge.

Tier 3 surprise challenges are excluded from the weekly completion calculation. Only Tier 1 and Tier 2 challenges count toward guarantee eligibility. Tier 3 challenges disappear on the day they appear and are not tracked for completion purposes.

Completion is determined solely by in-app logs. No external proof is required or accepted.

Completion logs cannot be edited by users. Once a day is recorded, you cannot change it, and neither the founding team nor anyone else can alter it at your request or at our own initiative to your disadvantage. This protects the integrity of the guarantee for everyone.

Correction of technical faults. The single exception is a verified technical fault on our side — for example a software bug, a failed synchronisation, a server outage, or a data migration error that caused the app to record something other than what you actually did. In that case we will correct the record so that it reflects your actual activity. Corrections are only ever made to reflect what genuinely happened; we will not add completions you did not earn, and a correction cannot reduce a completion you did earn. To report a suspected fault, email overcomeapp0@gmail.com with the subject line "Log Correction Request" as soon as you notice it, and in any event before your claim window closes.

Clarity Score. Your Clarity Score is calculated automatically by the app from your streak, challenge completions, lifestyle inputs, and consistency. It is a progress indicator only. It does not determine Cashback Guarantee eligibility, which depends solely on completed weeks as described in this Section. See Privacy Policy Section 2.7 for how this automated calculation works and how to request human review.

All weeks in the guarantee period must be completed. A single incomplete week disqualifies the claim.

5.4 Cashback Amounts

The cashback is 90% of the amount you actually paid at time of purchase, including where that amount reflects promotional pricing as defined in Section 4.1.

The 10% retained is not refundable as part of a Cashback Guarantee claim. This does not limit any refund you may be entitled to on another basis — including a refund under Section 13.2, a Google Play refund, or any right you have under applicable consumer law.

5.5 Claim Process

  1. Navigate to your Profile Page within the app.
  2. Tap the "Claim Cashback" button — visible only when your guarantee period has ended, all required weeks are complete, and you are within the claim window.
  3. The button opens a pre-filled email to overcomeapp0@gmail.com. Please leave the subject line and the pre-filled details intact, as they help us locate your account. You are welcome to add your own comments below them. If anything is missing or unclear we will email you to ask, rather than rejecting the claim.
  4. Send the email.
  5. The Overcome team will verify completion data within 2 business days.
  6. Claims must be submitted by email. Cashback claims raised through Founder's Chat are not valid submissions — see Section 12.5.
  7. If approved, cashback is processed within 7 to 10 business days as a partial refund through Google Play to your original payment method. Processing times at the payment provider are outside our control.
  8. If your claim is rejected, we will tell you which condition in Section 5.7 applied and how to appeal under Section 5.9.

Claims submitted outside these windows are automatically disqualified. No exceptions for late submissions regardless of reason.

5.7 Disqualifying Conditions

A claim will be rejected if any of the following apply:

What "falsified completion data" means. We use this term to describe deliberate conduct intended to record completions you did not actually perform. Specifically, it means:

Genuine mistakes, forgetting to log a day, connectivity problems, and technical faults on our side are not falsification. If your record is wrong because of a fault, that is a correction request under Section 5.2, not a disqualification.

We will only reject a claim on falsification grounds where we hold specific evidence of the conduct described above. We will tell you what we found and give you the opportunity to respond under Section 5.9 before the rejection becomes final. We will not reject a claim on suspicion, on a general sense that activity looks unusual, or because your completion pattern seems too consistent.

5.8 Guarantee Limitations

The guarantee applies only to the current active subscription period. It does not apply to cancelled subscriptions where the plan did not run to its full end date. The guarantee is not transferable.

The Cashback Guarantee is not an unconditional money-back guarantee. It is a reward for genuine, sustained engagement. Users who complete every required week and still feel no improvement are the intended beneficiaries. Users who did not fully engage are not eligible.

5.9 Appeals

If your claim is rejected, or if a correction request under Section 5.2 is refused, you may appeal.

  1. Email overcomeapp0@gmail.com with the subject line "Cashback Appeal" within 14 days of receiving our decision.
  2. Tell us why you think the decision was wrong. You may include anything you consider relevant, though no evidence is required.
  3. Your appeal will be reviewed by a named co-founder who did not make the original decision where that is possible, and by the other co-founder where it is not.
  4. We will respond with a final decision, and our reasons, within 10 business days.

Submitting an appeal pauses the claim window in Section 5.6 until the appeal is decided. Nothing in this Section limits your right to pursue the matter under Section 15 or under applicable consumer law.

5.10 Changing Plans Mid-Period

If you move from the 90-Day Reset to the 180-Day Full Reset during an active period, the weeks you have already completed carry across and count toward the longer plan's requirement. Your guarantee period, and the claim window in Section 5.6, are recalculated from the start date of the new plan.

If you move from a longer plan to a shorter one, your guarantee period ends at the end of the shorter plan's duration, and only the weeks falling within that period count.

Where a plan change results in a different amount paid, cashback is calculated on the total you actually paid across the combined period, less any amount already refunded to you.

8. Intellectual Property

All content within Overcome — including the Clarity Score system, challenge structures, badge designs, programme methodology, written content, visual design, and brand identity — is the intellectual property of Overcome and its co-founders.

You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial use during your active subscription. This licence does not permit copying, reproducing, distributing, or modifying any app content.

Nothing in this Agreement transfers any intellectual property rights to you.

9. Medical Disclaimer

Overcome is a habit-building tool. It is not a medical device, clinical treatment, therapy service, or substitute for professional mental health care. Nothing in the app constitutes medical advice, psychological treatment, or a clinical diagnosis. Overcome does not diagnose, treat, cure, or prevent any disorder, disease, or medical condition. Users experiencing serious mental health conditions — including depression, anxiety disorders, or compulsive disorders requiring clinical intervention — should consult a qualified healthcare professional. Do not delay seeking professional help because of anything you have read or experienced in this app.

The programme content in Overcome is based on general principles of habit formation and behavioural psychology. It is educational and motivational in nature. Individual results vary significantly and are not guaranteed.

10. Limitation of Liability

10.1 No Guarantee of Results

Overcome does not guarantee any specific outcome or improvement. Effectiveness varies between individuals and depends on factors outside our control.

10.2 Limitation of Damages

To the maximum extent permitted by applicable law, Overcome and its co-founders shall not be liable for:

In any circumstance where Overcome is found liable, our total liability shall not exceed the amount you paid for your current subscription period.

10.4 Indemnification

You agree to indemnify and hold harmless Overcome and its co-founders from any claims, damages, or expenses arising from your violation of these Terms or misuse of the app.

11. Service Disclaimers

Overcome is provided on an "as is" and "as available" basis. We make no warranties regarding the app's reliability, accuracy, availability, or fitness for a particular purpose. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice where possible.

12. Community and Communication Features

In this Section, "founding team" means the co-founders of Overcome and any person they formally authorise to operate a communication feature on their behalf. Where a feature is operated by anyone outside the co-founders, this Agreement and the Privacy Policy will be updated to say so before that feature becomes available to you.

12.1 Founder's Chat

Founder's Chat is a private text messaging channel between you and the Overcome founding team.

12.2 Founder's Chat Is Not Medical Advice

The founding team are not licensed therapists, counsellors, psychiatrists, or medical practitioners. What we send you in Founder's Chat is personal experience — approaches that worked for us — together with encouragement and motivation. Nothing we say in Founder's Chat is medical advice, psychological treatment, diagnosis, or a clinical recommendation, and none of it may be treated or relied upon as such. What worked for us may not work for you, and may not be appropriate for your circumstances.

Founder's Chat is not monitored continuously, is not staffed around the clock, and is not an emergency or crisis service. If you are experiencing a mental health crisis, or are thinking about harming yourself, do not use Founder's Chat — contact a qualified mental health professional or your local emergency services immediately.

The medical disclaimer in Section 9 applies in full to Founder's Chat and to every message sent through it. If anything we say leads you to consider changing, delaying, or stopping professional care you are receiving, speak to your healthcare provider first.

12.3 Availability and Response Times

12.4 Acceptable Use of Founder's Chat

When using Founder's Chat, you will not send:

Section 7 applies to Founder's Chat in full. We may restrict or withdraw your access to Founder's Chat, with or without notice, where we consider use of it abusive, disruptive, or in breach of these Terms. Withdrawal of Founder's Chat access alone does not terminate your subscription and does not entitle you to a refund.

12.5 Founder's Chat Is Not a Channel of Record

Founder's Chat is a support and encouragement channel only. It cannot be used to submit, substantiate, or preserve:

A message sent through Founder's Chat about any of the matters above is not a valid submission. It does not start, pause, extend, or stop any deadline, claim window, or response period under these Terms. In particular, raising a cashback claim in Founder's Chat will not preserve your 14-day claim window under Section 5.6.

12.6 No Variation of These Terms

Statements made by the founding team in Founder's Chat are informal and do not amend, waive, or override these Terms. No commitment concerning pricing, refunds, cashback eligibility, guarantee qualification, feature availability, or account status is binding on Overcome unless confirmed in writing by email from overcomeapp0@gmail.com. A failure to enforce any provision of these Terms in the course of a chat conversation is not a waiver of that provision.

12.7 Your Messages and Feedback

You retain ownership of the content you write. You grant Overcome a non-exclusive, royalty-free licence to store, read, and use your messages for the limited purposes of responding to you, operating and improving the app, and enforcing these Terms.

We will not publish, quote, or reproduce your messages in marketing materials, testimonials, case studies, social media, or any public-facing content without your separate, explicit, prior written consent. Where you give that consent, we will anonymise the content unless you agree otherwise in writing.

If you send us a suggestion, feature idea, or other feedback, you agree we may use it without restriction, obligation, or compensation to you. This does not give us any rights over content you own that is unrelated to Overcome.

You are responsible for what you choose to disclose. Do not send payment credentials, passwords, government identifiers, another person's personal information, or clinical records through Founder's Chat.

Storage, retention, and deletion of Founder's Chat messages are governed by Sections 2.5, 3, and 5.3 of the Privacy Policy.

12.8 Recovery Mentor Chat (Planned — Not Yet Available)

Recovery Mentor Chat is a planned feature and is not available at the time these Terms take effect. The terms below are published in advance so you know what to expect. They take effect only when the feature launches, and we will give notice under Section 14 before that happens.

When introduced, Recovery Mentor Chat will operate on the same private basis as Founder's Chat:

A Recovery Mentor is not a clinician. Recovery Mentors are trained peer supporters. Some may hold academic qualifications in psychology or a related field, but they are not registered with the Rehabilitation Council of India, are not licensed mental health professionals under the Mental Healthcare Act 2017, and do not practise as clinicians through Overcome. Nothing said in Recovery Mentor Chat will constitute medical advice, diagnosis, prescription, psychological treatment, or a clinical recommendation. It will not be a substitute for care from a qualified healthcare professional, and it will not be an appropriate channel in a crisis. Section 9 and Section 12.2 will apply to Recovery Mentor Chat in full.

Where we describe a Recovery Mentor's background or qualifications in the app, we will do so accurately and will not imply a clinical licence or professional registration that the person does not hold.

A Recovery Mentor is a separate person from the founding team and will be bound by a written confidentiality obligation before being given access to any user conversation. Before launch, we will publish additional terms covering scheduling, session cadence, missed and rescheduled sessions, the mentor's role and limits, confidentiality, escalation where a user appears to be at risk, cost, and what happens if the feature is unavailable. We will also update the Privacy Policy to record that a Recovery Mentor will have access to your messages, and to describe the media types collected. Participation will be subject to those additional terms alongside this Agreement.

12.9 Community Forum (Planned — Not Yet Available)

The Community Forum is a planned feature and is not available at the time these Terms take effect. The content standards below are published in advance. They take effect only when the feature launches, and we will give notice under Section 14 before that happens.

When introduced, the Community Forum will allow you to publish text and image posts that other users can view, comment on, and discuss. Unlike Founder's Chat and Counsellor Chat, the Forum is not private.

Anything you post in the Forum will be visible to other users of Overcome under your display name. Do not post anything you are not willing for other people to see, and remember that your display name does not need to be your real name. Once content has been seen, commented on, or copied by another user, we cannot undo that, even if you later delete the post.

Content standards. All Forum content must be suitable for a general audience and comply with these standards. You may not post, link to, or otherwise share:

Moderation. We may review, edit, restrict, or remove any Forum content at our discretion, with or without notice, and may suspend or withdraw Forum access from any user who breaches these standards. Repeated or serious breaches may result in termination of your account under Section 13.2, without refund. We do not undertake to review every post before it appears, and content posted by other users is their responsibility, not ours.

Reporting. When the Forum launches, we will provide an in-app mechanism to report objectionable content and to block other users. You can also report content to overcomeapp0@gmail.com with the subject line "Forum Report". We will act on reports of objectionable content within 24 hours of receiving them.

Your posts. You retain ownership of what you post. By posting, you grant Overcome a non-exclusive, royalty-free, worldwide licence to host, store, display, and distribute that content within the app for the purpose of operating the Forum. This licence ends when you delete the post or your account, except for copies retained in backups or where retention is required by law, and except for the fact of other users having already seen it.

Before launch, we will publish additional community guidelines and update the Privacy Policy to describe how Forum content is stored, moderated, retained, and deleted. Participation will be subject to those additional terms alongside this Agreement.

13. Account Deletion and Termination

13.1 Deletion by You

You may request deletion of your account at any time:

How to request account deletion:

  1. Tap "Request Account Deletion" on your Profile Page. This opens a pre-filled email to overcomeapp0@gmail.com.
  2. Send the email without modifying the subject line.
  3. We will confirm receipt within 48 hours and permanently delete your account within 30 days.

Alternatively, email overcomeapp0@gmail.com directly with subject line "Data Deletion Request". Deletion requests must be made by email; a request made through Founder's Chat is not a valid request — see Section 12.5. Deletion of your account terminates this Agreement. For full details of what is deleted and retained, refer to the Privacy Policy Section 5.3.

13.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, if we believe your use is fraudulent or harmful, or if required by law. No refund will be issued for termination due to a Terms violation.

Where we terminate your account for a reason unrelated to your conduct — for example because we discontinue the service — we will request a refund of the unused portion of your current subscription period through Google Play. "Unused portion" means the part of the period you paid for that had not yet elapsed on the date of termination.

Because all payments are handled by Google Play and we do not hold your money, we can initiate and support that request but cannot guarantee its outcome, timing, or the method by which Google returns the funds. Where Google declines a refund we would otherwise have granted, contact us at overcomeapp0@gmail.com and we will work with you to find an alternative resolution.

13.3 Effect of Termination

Upon termination, your licence ends immediately, access is revoked, and your data is handled per our Privacy Policy.

14. Changes to These Terms

Continued use after changes take effect constitutes acceptance.

If you do not accept a material change, you may tell us so by email at overcomeapp0@gmail.com before it takes effect. In that case your current subscription period continues to be governed by the version of these Terms you originally accepted, until that period ends. The new Terms will apply from your next renewal, and you may cancel before then. You do not lose your Cashback Guarantee eligibility by refusing a change.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of India.

15.2 Informal Resolution

Before any formal dispute, contact us at overcomeapp0@gmail.com with a written description of your complaint. We will make reasonable efforts to resolve it within 30 days.

15.3 Jurisdiction

Unresolved disputes are subject to the jurisdiction of courts in Bengaluru, Karnataka, India.

This does not affect your rights under the Consumer Protection Act 2019. If you are a consumer, you may bring a complaint before the consumer commission having jurisdiction where you reside or work, and nothing in this Agreement prevents you from doing so.

16. Contact and Dispute Queries

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms published for a specific feature, form the entire agreement between you and Overcome and replace any earlier understanding, representation, or communication on the same subject. Section 12.6 sets out the effect of informal statements made in Founder's Chat.

17.2 Severability

If any provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed. The remaining provisions continue in full force.

17.3 No Waiver

If we do not enforce a provision of these Terms, or delay in doing so, that is not a waiver of that provision or of our right to enforce it later.

17.4 Assignment and Change of Operator

You may not transfer or assign your account or your rights under these Terms to anyone else.

We may transfer or assign this Agreement, in whole or in part, to a successor entity — including a company incorporated by the co-founders to operate Overcome, or an acquirer of the Overcome business — provided that the successor assumes our obligations under these Terms and the Privacy Policy in full.

Overcome is presently operated by its co-founders as individuals. We intend to incorporate a company to operate it. When that happens, this Agreement and the Privacy Policy will transfer to that company on the same terms, your subscription and Cashback Guarantee eligibility will be unaffected, and we will notify you under Section 14. Your data will continue to be processed on the same basis, and the incorporation itself will not change what we collect, how long we keep it, or who can access it.

17.5 Force Majeure

We are not liable for any failure or delay in providing Overcome caused by events beyond our reasonable control, including internet or hosting provider failure, failure of Google Play or other third-party services we depend on, power or telecommunications failure, natural disaster, epidemic, civil unrest, war, strike, cyberattack, or government or regulatory action. Where such an event materially affects your ability to complete challenge weeks, we will extend your guarantee period by a corresponding number of days rather than disqualify your claim.

17.6 Survival

Sections 8 (Intellectual Property), 9 (Medical Disclaimer), 10 (Limitation of Liability), 12.7 (Your Messages and Feedback), 15 (Governing Law and Dispute Resolution), and this Section 17 survive termination of this Agreement for any reason.

17.7 Language

These Terms are published in English. Where we provide a translation, the English version prevails in the event of any inconsistency.
